1. Requirements for establishment of a preschool

For establishment of a preschool in Vietnam, an investor must satisfy certain requirements as follows[1]:

• The proposal for establishment of a preschool must be consistent with the local socio-economic and educational network development plan approved by the state regulatory authority.
• The proposal for establishment of a preschool must clearly define preschool objectives, missions, curriculum framework and outline; land, facilities, equipment and intended construction site; organization and personnel structure, financial and other resources; guidelines and strategies for construction and development.

2. Procedure for establishment of a preschool[2]

2.1 Application files for establishment of a preschool

• The application form for approval of establishment of a preschool in which necessity for establishment of a preschool, proposed name of a preschool and location intended for construction of a preschool must be clearly specified.
• The proposal for establishment of a preschool.

2.2 Process for carrying out procedure for establishment of a preschool

• Step 1: The investor shall submit an application files for establishment of a preschool, whether directly or by post, to the district-level People’s Committee.
• Step 2: Within 5 business days from date of full receipt of lawful application files for establishment of a preschool, the district-level People’s Committee shall conduct requirements assessment for establishment of a preschool and the President of district-level People’s Committee shall issue a decision on approval or refusal of establishment of a preschool.
• Note: If a preschool fails to obtain the permi for educational operation within 02 years from the date of decision on establishment of a preschool, such decision shall be abolished.

3. Requirements for operations after establishment of a preschool[3]

• Owning land, school head office, facilities and equipment that meet requirements, help maintain and develop preschool activities in accordance with laws.
• Employing an adequate staff of administrative officers, teachers and employees that are structured in a proper manner and meet stipulated standards for provision of preschool education programs and organization of educational activities.

4.1 Application dossier for obtaining an operation permit after establishment of a preschool

• An application form for the license to carry out preschool
• A lawful duplicate copy of the decision on approval for the establishment of a preschool.
• A list of officers holding important positions, such as the rector, vice rectors, heads of specialized groups, teachers; employment contracts signed between a preschool and each managerial officer or each teacher.
• A preschool education curriculum and syllabus for offer of preschool education program.
• An inventory of classrooms, working rooms, facilities and equipment items meeting stipulated requirements.
• Legal confirmation documents prove a sufficiency of requirements for head office, financial capacity which ensure operations of the preschool in accordance with laws.
• Statutes of organization and operation of a preschool.

4.2 Procedure for obtaining an operation permit after establishment of a preschool

• Step 1: The preschool shall submit application files for procedure for obtaining an operation permit after establishment of a preschool, whether directly or by post, to the Subdepartment of Education and Training.
• Step 2: The Subdepartment of Education and Training shall conduct an assessment of application files within 5 business days from date of receipt of application files,.
• Step 3: The Subdepartment of Education and Training shall conduct a field inspection at the preschool within 15 business days from date of the assessment completion.
• Step 4: The Head of the Subdepartment of Education and Training shall issue a decision on approval or refusal of operations license of the preschool within 5 business days from date of a field inspection,.
