Disputes in trade, commerce are undesirable. However, when it is impossible to reach a common voice to come to a smooth agreement, the parties of the dispute can initiate a commercial dispute at the Court or at the Arbitration if the parties have the agreement on dispute settlement by Commercial Arbitration.
When deciding to settle a dispute at a Court, the plaintiff shall make a form of petition on commercial dispute attach with documents and evidence proving the legitimate rights and interests of the infringed plaintiff and submit it to the Court via the following ways: (i) Direct submission at Court; (ii) Submitted to the Court by postal; and (iii) Sending through e-portal of Courts (if any).

Instructions for use form of petition on commercial dispute:
(1) Fill out the location where to write the petition ( for example: Hanoi, date____ month____ year ___).
(2) Fill out the name of the Court has jurisdiction to setttle the case; If it is the district-level People’s Court, it is necessary to specify which district People’s Court belongs to which province or central city (for example: People’s Court of district A of province B), if it is the People’s Court of the province, clearly state the People’s Court of the province (city) (for example, the People’s Court of Hung Yen province) and the address of that Court.
(3) If the plantiff is an individual, fill out the full name; In case the plantiff is a minors, legally incapacitated persons or, persons with limited capacity of exercise, people with limited cognition or behavior control, fill out full name and address of the legal representative of that individual; If the plaintiff is an company or organization, fill out the name of the agency or organization and fill out the full name of the legal representative of such agency or organization.
(4) Enter your place of residence at the time of filing the petition. If the plantiff is an individual, fill out down his/her address of residence (for example: Nguyen Van A, residing in village B, commune C, district M, province H); If the petitioner is an agency or organization, write the address of the head office of that company or organization (for example: Hin Sen Co., Ltd. has its head office: No. 20, LTK street, district HK, city H) .
(5), (7), (9) and (12) Fill out the instructions in point (3).

(11) Specify each issue to be resolved by the Court.
(14) Clearly state the names of the documents attached with the petition include which documents must be numbered (for example, the documents accompanying the application include: copy of house sale contract, paper copy certification of land use rights,…).
(15) Fill out information that the plantiff deems necessary for the resolution of the case (for example: The petitioner notifies the Court when there is a dispute when one of the parties has gone abroad for medical treatment. …).
(16) If the plantiff is an individual, the plantiff’s signature or fingerprint is required; In case the plantiff is a minors, legally incapacitated persons or, persons with limited capacity of exercise, people with limited cognition or behavior control, such legal representative must sign and fingerprint; If the plaintiff or legal representative is illiterate, cannot see, cannot file a lawsuit by himself/herself, cannot sign his/her own signature or fingerprint, the person with full civil procedure act capacity shall witness, sign for confirmation on the petition. If the company, organization initiates a lawsuit, the legal representative of the company or organization initiating the lawsuit shall sign and write his/her full name and position and affix the seal of such agency or organization. In case company initiating the lawsuit is an enterprise, the use of the seal shall comply with the provisions of the Enterprise Law. If the petitioner is illiterate, witnesses must sign for certification according to the provisions of Point c, Clause 2, Article 189 of the Civil Procedure Code.
